Terms & Conditions

These terms and conditions (“Terms”) govern the purchase of bicycles (“Bicycle” or “Bicycles”) from Ivanhoe Cycles (“Seller”) via the Seller’s website (“Website”).

By placing an order for a Bicycle through the Website, you agree to be bound by these Terms.

These terms and conditions (Terms) apply to the purchase of an XDS Bicycle(s) from Ivanhoe Cycles (“Ivanhoe Cycles”, “we”, “us” and “our”) by the Ivanhoe Cycles customer (“Customer”, “you” or “your”).

You are deemed to accept these Terms when you place an order for an XDS Bicycle(s) on our website (www.ivanhoecycles.com.au).

1. Purchase Agreement

By completing the checkout process on the Website, you are making an offer to purchase the Bicycle(s) in your cart.
The purchase agreement between you and the Seller is formed when the Seller accepts your order.

2. Product Availability

All orders are subject to availability. In the event that a Bicycle is out of stock or unavailable, the We will notify you and offer a refund or alternative product.
Only frame sizes that are labelled "Free Shipping" are applicable for free shipping.

3. Pricing and Payment

All prices listed on the Website are in AUD and inclusive of applicable taxes, unless otherwise stated.
Payment for the Bicycle(s) must be made in full at the time of placing the order.
The Seller reserves the right to change prices at any time without notice.

4. Delivery

Your bike will be boxed and professionally packaged to your delivery address. **Authority to Leave must be provided**.
Delivery to metropolitan areas is up to 6 business days. Delivery to rural and remote areas is up to 15 business days. These are estimates and subject to change.
Please allow up to 24 hours for Order tracking to be emailed to you by us.
The Seller will endeavor to deliver the Bicycle(s) to the address provided by you during the checkout process within the specified time frame.
Delivery times are estimates and subject to change. The Seller is not liable for any delays in delivery.
Risk of loss to the Bicycle(s) passes to you upon delivery.
Upon delivery, if the Bicycle(s) box sustains significant damage (excluding light scratches or minor depressions) email staff@ivanhoecycles.com.au with:

* Proof of purchase invoice.

* Several images of the outside of the box with shipping label.

* Images of damaged components.

Please do not handle the Bicycle(s) until we process your claim and advise on next steps.

5. Returns and Refunds

By completing the purchase, the customer acknowledges and agrees that all sales are final.

6. Warranty

XDS provides a 10-year warranty on all frames covering manufacturing defects and faulty workmanship.
Warranty on parts is 12 months unless otherwise stated by the manufacturer.
Modifications to the original build will void the manufacturer’s warranty.
This warranty does not cover normal wear and tear, misuse, or damage caused by accidents or improper assembly.
Item(s) covered under warranty do not include the cost of labour associated with replacing these item(s).

7. Limitation of Liability

To the fullest extent permitted by law, the Seller shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the purchase or use of the Bicycle(s).
In no event shall the Seller's total liability exceed the purchase price paid for the Bicycle(s).

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, without regard to its conflict of law principles.

9. Modification of Terms

The Seller reserves the right to modify or update these Terms at any time without prior notice. Changes will be effective immediately upon posting on the Website.

10. Assembly

When you receive the Bicycle(s), assembly will be required. This includes front wheel, pedals, handlebars and seat/seat post.
We strongly advise assembly be performed by a qualified mechanic.
The customer acknowledges that assembly of the bicycle(s) is their responsibility and releases Ivanhoe Cycles from any liability arising from improper assembly, including but not limited to accidents, injuries, or damages caused by the mis-assembly of the bicycle(s).

11. Cancellation Fee

If the Bicycle(s) has not been shipped, you may cancel your order placed on the Website. Cancelled orders will incur a $50.00AUD administration fee (per order). This will be deducted from your purchase price.

Our Free Service offer is available for bikes purchased in-store at any Ivanhoe Cycles location.
Shipped bikes do not qualify for this offer.
